These Terms and Conditions (“Terms”) govern your use of the CDJ Peppers LLC website, located at [www.cdjpepepperz.com] (“Site”), and all services offered by CDJ Peppers LLC, a Wyoming limited liability company (“Company,” “we,” “us,” or “our”). By accessing the Site or using our services, you (“User,” “you,” or “your”) agree to be bound by these Terms. If you do not agree, do not use the Site or our services.

1. DESCRIPTION OF SERVICES

CDJ Peppers LLC provides educational coaching and consultation services regarding peptide research compounds. Our services consist of sharing our understanding of published research literature, general educational information about peptide compounds, and the personal experiences reported by individuals we have worked with. Our services are strictly educational and informational in nature.

WE ARE NOT MEDICAL PROVIDERS. Our services do NOT constitute medical advice, diagnosis, treatment, or prescribing of any kind. Nothing on this Site or communicated during any coaching session should be construed as a recommendation to use, consume, inject, or otherwise administer any compound for human use. You should consult a licensed physician before making any health-related decisions.

Legal basis: The compounds discussed on this Site are research compounds that are not approved by the U.S. Food and Drug Administration (“FDA”) for human consumption. See 21 C.F.R. § 201.128 (intended use doctrine); FD&C Act § 201(g)(1), 21 U.S.C. § 321(g)(1) (definition of “drug”).

 

2. ELIGIBILITY

You must be at least 18 years of age to use this Site or our services. By using this Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

 

3. COACHING SESSIONS

(a) Booking. Coaching sessions may be booked through the Site or by contacting us directly. Session availability is subject to change without notice.

(b) Payment. Payment for coaching sessions is handled separately and is due prior to the scheduled session. We currently accept payment via Zelle. Sessions will not be confirmed until payment is received.

(c) Intake Form. Prior to your first coaching session, you must complete a Coaching Intake Form.

(d) Waiver. Before any coaching session begins, you must review and sign a Coaching and Consultation Disclaimer, Assumption of Risk, and Release of Liability. No session will proceed without a signed waiver.

(e) Cancellation. If you need to cancel or reschedule a session, please provide at least 24 hours’ notice. Sessions cancelled with less than 24 hours’ notice may be subject to forfeiture of the session fee.

 

4. RESEARCH USE ONLY

All compounds discussed on this Site or during coaching sessions are research compounds sold by their respective manufacturers for research purposes only. They are not approved by the FDA for human consumption, and we make no representations regarding the safety, efficacy, or legality of any compound for human use. Any decision to purchase, handle, or interact with research compounds is made entirely at your own risk.

 

5. AFFILIATE RELATIONSHIPS

CDJ Peppers LLC may maintain affiliate relationships with research compound suppliers and other third parties. If we recommend a product or link to a third-party website, we may earn a commission on resulting purchases. All affiliate relationships are disclosed in accordance with the Federal Trade Commission’s Endorsement Guides (16 C.F.R. Part 255). Our recommendations reflect our genuine opinions based on personal research, but you should conduct your own due diligence before making any purchasing decisions.

6. INTELLECTUAL PROPERTY

All content on this Site, including text, graphics, logos, images, audio, video, and software, is the property of CDJ Peppers LLC or its content suppliers and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, display, perform, or otherwise use any content from this Site without our prior written consent.

 

7. USER CONDUCT

You agree not to: (a) use the Site for any unlawful purpose; (b) record, reproduce, or distribute the content of any coaching session without prior written consent; (c) misrepresent your identity or provide false information; (d) use information obtained from our services to compete with CDJ Peppers LLC or to solicit our clients, vendors, or business partners; or (e) attempt to gain unauthorized access to the Site or its systems.

 

8. DISCLAIMER OF WARRANTIES

THE SITE AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE MAKE NO WARRANTIES OR GUARANTEES REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY INFORMATION PROVIDED ON THE SITE OR DURING COACHING SESSIONS.

 

9. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, CDJ PEPPERS LLC, ITS MEMBERS, MANAGERS, OFFICERS, AGENTS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR OUR SERVICES, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SITE OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO CDJ PEPPERS LLC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

 

10. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless CDJ Peppers LLC, its members, managers, officers, agents, and employees from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Site or our services; (b) your purchase, use, handling, or administration of any research compound; (c) your violation of these Terms; or (d) your violation of any applicable law or regulation.

 

11. CONFIDENTIALITY

All information, materials, and communications shared during coaching sessions are confidential and proprietary to CDJ Peppers LLC. You shall not record, reproduce, distribute, or publicly disclose the content of any coaching session without our prior written consent. You shall not use any information obtained during coaching sessions to compete with our business or to solicit our clients, vendors, or business partners. This confidentiality obligation survives the termination of your relationship with us.

 

12. DISPUTE RESOLUTION

(a) Good Faith Negotiations. You agree to attempt in good faith to resolve any dispute arising out of or relating to these Terms through direct negotiations for a period of thirty (30) days following written notice.

(b) Mediation. If the dispute is not resolved, the parties agree to submit it to non-binding mediation before a mutually agreed-upon mediator.

(c) Binding Arbitration. If mediation is unsuccessful, any dispute shall be resolved by binding arbitration in Orange County, California, conducted by a single arbitrator under the rules of JAMS. The arbitrator’s decision shall be final and binding.

(d) WAIVER OF JURY TRIAL. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU IRREVOCABLY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES.

(e) WAIVER OF CLASS ACTION. YOU AGREE THAT ANY DISPUTE SHALL BE BROUGHT SOLELY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

13. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles.

 

14. THIRD-PARTY LINKS

The Site may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of third-party sites. Inclusion of any link does not imply endorsement. You access third-party sites at your own risk.

 

15. MODIFICATIONS

We reserve the right to modify these Terms at any time. Changes will be effective when posted to the Site with an updated effective date. Your continued use of the Site after changes are posted constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

 

16. SEVERABILITY

If any provision of these Terms is held to be unenforceable, the remaining provisions shall remain in full force and effect.

 

17. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy and any signed Coaching and Consultation Disclaimer, constitute the entire agreement between you and CDJ Peppers LLC regarding your use of the Site and our services.
